Questions

Which party wall notice do I need?+

Section 3 for work to the shared wall itself (steels for a loft, removing a chimney breast). Section 6 for digging foundations within 3 m of a neighbour’s building, or 6 m for deeper work. Section 1 for a new wall on the boundary line. Many extensions need more than one.

How much notice do I have to give?+

Two months for a Section 3 Party Structure Notice and one month for Section 1 and Section 6 notices. Your neighbour can agree to a shorter period in writing.

What happens if my neighbour does not reply?+

If they do not respond within 14 days, they are treated as dissenting and a dispute is deemed to have arisen. Surveyors are then appointed to agree a Party Wall Award.

Who do I serve it on?+

Every owner of the adjoining property with an interest of more than a year — usually the freeholder and any long leaseholders. Check the Land Registry title for the names.
